Terms of Service

These Terms of Service ("Terms") govern your use of the Convivial iOS application ("App") provided by Fenrir Digital Oy ("we", "our", or "us"). By installing or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

Convivial is a read-only dashboard and Home Screen widget suite for hosts who manage short-term rentals with Hospitable. It reads your Hospitable data using a personal access token you provide and computes metrics such as occupancy, revenue on the books, average daily rate, and pace. The App never modifies data in Hospitable.

Convivial is an independent product. It is not affiliated with, endorsed by, or sponsored by Hospitable, Airbnb, Booking.com, or Expedia. Those names are trademarks of their respective owners.

2. Eligibility and Accounts

You must be at least 18 years old and hold a Hospitable account you are entitled to access. The App creates no account of its own. You are responsible for the personal access token you paste into the App, for keeping your device secure, and for revoking the token in Hospitable if your device is lost or compromised.

3. Hospitable Access

Your use of Hospitable and its API remains governed by Hospitable's own terms. You are responsible for ensuring that connecting a third-party application is permitted under your Hospitable plan and applicable law. We are not responsible for changes, outages, or rate limits of the Hospitable API that affect the App.

4. Guest Data

The App displays guest information that Hospitable makes available to you as a host. You act as the data controller for that information. You agree to use it only for managing your own rentals and in compliance with applicable privacy laws and the policies of the booking platforms involved.

5. Subscriptions and Payments

The core App and one small widget are free. Additional widgets and features are available with a Convivial Pro subscription, offered monthly or annually.

• Subscriptions are purchased through Apple's App Store and billed to your Apple account
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your Apple account settings
• Any free trial or introductory offer converts to a paid subscription unless cancelled before the trial ends
• Prices may vary by region and may change; changes apply from the next renewal after notice
• Refunds are handled by Apple under its App Store policies

6. Acceptable Use

You agree not to:

• Use the App with a token or account you are not authorised to use
• Reverse engineer, decompile, or tamper with the App except where the law permits
• Use the App to violate any law or the rights of others, including guests
• Circumvent subscription entitlements or purchase mechanisms

7. Intellectual Property

The App, its design, and its code are owned by Fenrir Digital Oy and protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, in accordance with Apple's App Store terms. Your Hospitable data remains yours.

8. Data Accuracy

Metrics are computed from the data Hospitable returns and from the settings you choose (for example revenue including or excluding VAT). Figures may differ from Hospitable, booking platforms, or your accounting. The App is a convenience tool and not a substitute for financial, tax, or legal advice. Verify figures before relying on them.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that metrics will be accurate or complete.

10. Limitation of Liability

To the fullest extent permitted by law, Fenrir Digital Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, bookings, profits, or data arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights.

11. Indemnification

You agree to indemnify and hold harmless Fenrir Digital Oy from claims, damages, and expenses arising from your breach of these Terms or your misuse of guest or Hospitable data through the App.

12. Termination

You may stop using the App at any time by disconnecting in Settings or deleting the App. We may suspend or terminate access to the App or to Pro features if you breach these Terms. Sections 7 through 11 survive termination.

13. Apple

These Terms are between you and Fenrir Digital Oy, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to Terms

We may update these Terms. The current version is published at this address with an updated effective date. Continued use of the App after a change means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Finland. Disputes are resolved in the District Court of Helsinki, unless mandatory consumer protection law gives you the right to a different forum. Consumers in the EU may also use the European Commission's online dispute resolution platform.
